The following Terms and Conditions of Sale and Delivery apply to all Best Wine Auctions BVBA auctions sales. The conditions are available for anyone to consult and are also included on our home page. We will send you a written copy on request.
All final auction-prices are in Euro, exclusive of VAT and exclusive of delivery costs and local taxes, unless stated otherwise.
The buyer's premium or commission is 18.50 % ex VAT.
Best Wine Auctions BVBA reserves the right to change prices and correct any errors at any time. If a price change has an effect on your bid (s) you have placed, you have the right to cancel them without any charge.
All photographic images and illustrations are unique and may not be used for other purposes. We show you the best representative picture(s) of the bottle(s) on our website – but small differences may never be used for any dispute or claims.
Best Wine Auctions BVBA, is a Belgian company, is subject to the Belgian law, regulations and procedures. If the recipient of our products is not located in the country from which they are dispatched, the recipient is liable for any sales tax or import duty in the destination country.
Best Wine Auctions BVBA only delivers orders after full payment has been received in advance on our bankaccount

All payments need to be fulfilled within 7 days after closure of the auction. Best Wine Auctions BVBA has the right to cancel the sale if the payment is not received in time.
All our prices are exclusive of transport and insurance costs. If possible Best Wine Auctions BVBA is happy to organise transport for you. We will select a carrier depending on the size and urgency of your order. We will send you a quotation for the delivery costs for your approval.
This is a service we cannot guarantee for all countries.
If, on receipt, you notice that the delivered product does not correspond to your order, you must contact us directly by e-mail (info@bestwineauctions.com) Your complaint will then be handled accordingly.
As we auction old and exclusive wines, it is not possible for us to offer any form of guarantee - we always strive to supply products of the highest possible quality - however it is impossible for us to offer any guarantee for any wines
With regard to cork tainted wine, as this happens during the bottling process we cannot revert to the producer and it is also impossible for us to offer any guarantee for such cases.
It is not allowed to cancel the wines you have bought on our auction – because we trade in perishable goods and goods that are related to economical fluctuations and sensitive to the stock market the consumer protection law is inapplicable.
Best Wine Auctions BVBA guarantees that your personal details and information will be handled with the strictest confidence and will not be made available to third parties.
In the event of a dispute, the Courts of Antwerp shall be the sole competent courts. The amount of any potential damages can never exceed the value of the ordered and delivered goods.
All disputes are subject to the exclusive jurisdiction of the courts of Antwerp. Information regarding alternative dispute resolution can be found via this link: http://ec.europa.eu/odr nevertheless we reserve the right to submit any disputes exclusively to the courts.
12. DAC7
From 1 January 2023, Best Wine Auctions must comply with the EU directive DAC7.
DAC7 is a directive designed to improve administrative cooperation between EU member states by requiring the collection and reporting of specific information about sellers to tax authorities.
We ensure that this information is processed securely and in accordance with our data protection and privacy policy.
Who does DAC7 apply to?
DAC7 applies to private and professional sellers who meet both of the following criteria:
Reside in an EU member state. Have sold 30 or more special items, or generated a total turnover of more than €2,000 on our online platform within a calendar year.
For sellers registered with Best Wine Auctions before 1 January 2023, the notification requirement will first apply on 31 January 2025 and will then only apply to sales made in 2024.
What you need to do
If you meet the DAC7 criteria, we will notify you via email and display a notification when you zic in to your Best Wine Auctions account.
You have already provided most of the required information when you created your account or completed the seller verification process. We will inform you of any missing data and guide you in adding the required DAC7 information.
Required information for DAC7
Private sellers:
First and last name - Residential address - Tax Identification Number (TIN) or, if not available, place and country of birth - Date of birth
Professional sellers:
Legal business name - Registered business address - Tax Identification Number (TIN)
VAT number - Company registration number
Information on the existence of a permanent establishment (PE) within the EU
All sellers:
Bank account number - Income from sales - Vendor commission
Taxes withheld or levied, if applicable
Number of items sold
You must provide the required information within 60 days of our request. We will send three reminders before the 60-day period expires.
If you fail to submit the information within the 60-day period, your account may be temporarily suspended. Once you provide the required information, your account will be reactivated.
We will verify the submitted information against the data we already have on file. If there are any discrepancies or questions, we will contact you for clarification.
As Best Wine Auctions is headquartered in Belgium, we will securely share the DAC7 information with the Belgian tax authorities, who will then pass it on to your local tax authorities.
