Best Wine Auctions BVBA strives for transparency and professionalism in the buying and selling of fine wines through its auction platform.

All final auction prices are stated in euros and exclude VAT, shipping costs, insurance, handling costs and any applicable local taxes, unless otherwise specified. For lots designated as VAT lots, the applicable VAT will be added to the final auction price.

Buyers are subject to a buyer’s premium or commission of 19.50%, excluding VAT. VAT is applicable to the buyer’s premium in accordance with the applicable VAT regulations.

Best Wine Auctions BVBA reserves the right to change prices and correct any errors at any time.
If a price change affects a bid you have placed, you have the right to cancel that bid without charge.

All photographs, images and illustrations shown on the Best Wine Auctions website are unique and may not be used for any other purpose without prior written permission.

Best Wine Auctions BVBA aims to show the most representative image or images of the bottle or bottles offered. Minor differences between the photographs and the delivered bottle or bottles cannot be used as grounds for disputes, claims or compensation.

Best Wine Auctions BVBA is a Belgian company and is subject to Belgian law, regulations and procedures.

If the recipient of the products is located outside the country from which the products are dispatched, the recipient is responsible for any sales tax, customs duties, import duties or other taxes applicable in the destination country.

Best Wine Auctions BVBA only delivers orders after full payment has been received in advance.

All payments must be completed within seven days after the closure of the auction.

Best Wine Auctions BVBA reserves the right to cancel the sale if payment is not received within the required timeframe.

All prices exclude transport, insurance and handling costs. 

Where possible, Best Wine Auctions BVBA can arrange transport on behalf of the buyer. A carrier will be selected depending on the size, value and urgency of the order.

Best Wine Auctions BVBA will provide a quotation for delivery costs for approval before transport is arranged.

This transport service may not be available for all countries.

If, on receipt, you notice that the delivered product does not correspond to your order, you must contact us directly by e-mail (info@bestwineauctions.com) Your complaint will then be handled accordingly.

Best Wine Auctions BVBA auctions old, rare and exclusive wines. Due to the nature, age and condition sensitivity of these products, it is not possible to offer any form of guarantee.

Best Wine Auctions BVBA always strives to supply products of the highest possible quality. However, no guarantee can be offered with regard to the condition, drinkability, taste, cork quality or future performance of any wine.

With regard to cork-tainted wine, this condition can originate during the bottling process. As Best Wine Auctions BVBA cannot revert to the producer in such cases, no guarantee or compensation can be offered.

It is not permitted to cancel wines purchased through an auction of Best Wine Auctions BVBA.

Best Wine Auctions BVBA trades in perishable goods and goods that are subject to economic fluctuations and market sensitivity. For this reason, consumer protection cancellation rights may not apply.

Best Wine Auctions BVBA guarantees that personal data and information will be handled with the strictest confidence.

Personal data will not be made available to third parties, except where required for the execution of services, legal obligations, tax reporting, payment processing, transport, compliance or other legitimate business purposes.

In the event of a dispute, the courts of Antwerp shall have exclusive jurisdiction.

The amount of any potential damages can never exceed the value of the ordered and delivered goods.

All disputes are subject to the exclusive jurisdiction of the courts of Antwerp.

Information regarding alternative dispute resolution can be found via the European Online Dispute Resolution platform.

Best Wine Auctions BVBA nevertheless reserves the right to submit any disputes exclusively to the competent courts.

As of 1 January 2023, Best Wine Auctions BVBA must comply with the European Union DAC7 directive.

DAC7 is a directive designed to improve administrative cooperation between EU member states by requiring the collection and reporting of specific information about sellers to tax authorities.

Best Wine Auctions BVBA ensures that this information is processed securely and in accordance with its data protection and privacy policy.

DAC7 applies to private and professional sellers who meet both of the following criteria:

- The seller resides in an EU member state.
- The seller has sold 30 or more items, or has generated total turnover of more than €2,000 on the Best Wine Auctions platform within a calendar year.

For sellers registered with Best Wine Auctions before 1 January 2023, the notification requirement first applies on 31 January 2025 and only applies to sales made in 2024.

If you meet the DAC7 criteria, Best Wine Auctions BVBA will notify you by email and may display a notification when you log in to your Best Wine Auctions account.

You may already have provided most of the required information when creating your account or completing the seller verification process. Best Wine Auctions BVBA will inform you of any missing data and guide you in adding the required DAC7 information.

You must provide the required information within 60 days of our request. Best Wine Auctions BVBA will send three reminders before the 60-day period expires.

If you fail to submit the required information within the 60-day period, your account may be temporarily suspended. Once the required information has been provided, your account may be reactivated.

Best Wine Auctions BVBA will verify the submitted information against the data already held on file. If there are discrepancies or questions, Best Wine Auctions BVBA may contact you for clarification.

As Best Wine Auctions BVBA is headquartered in Belgium, the required DAC7 information will be securely shared with the Belgian tax authorities, who may then share it with the relevant local tax authorities.
